{"id":865,"date":"2025-06-11T17:15:28","date_gmt":"2025-06-11T17:15:28","guid":{"rendered":"https:\/\/gta.com.mx\/?p=865"},"modified":"2025-06-30T17:32:33","modified_gmt":"2025-06-30T17:32:33","slug":"on-top-of-your-things","status":"publish","type":"post","link":"https:\/\/gta.com.mx\/en\/2025\/06\/11\/on-top-of-your-things\/","title":{"rendered":"ON TOP OF YOUR THINGS"},"content":{"rendered":"<p id=\"ember3309\">Aunque parezca incre\u00edble, del inventario de asuntos que recibimos en nuestra Firma Jur\u00eddica, descubrimos con sorpresa que muchos son consecuencia de la desatenci\u00f3n que sobre ellos tuvieron sus due\u00f1os o titulares.<\/p>\n\n\n\n<p id=\"ember3310\">Nuestra clientela es emprendedora por naturaleza, y es com\u00fan verlos enfocados en el futuro, en nuevos proyectos y en el desarrollo de negocios; por su propio dinamismo, son pocos los empresarios que se abocan al cuidado, documentaci\u00f3n, productividad y sucesi\u00f3n de su patrimonio personal.<\/p>\n\n\n\n<p id=\"ember3311\">Pareciere que con la eventual lectura de su estado patrimonial es suficiente, y la tarea es enfocarse a continuar acrecentando el patrimonio, pero sin mirar lo ya logrado. La necia realidad nos indica otra cosa.<\/p>\n\n\n\n<p id=\"ember3312\">Algunos ejemplos cl\u00e1sicos de consulta son:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inmuebles desatendidos, sobre los que ahora un tercero paga puntualmente el predial y tiene posesi\u00f3n;<\/li>\n\n\n\n<li>Empresas exitosas que carecen de certificados accionarios, pero que fueron constituidas por el fundador en compa\u00f1\u00eda de \u201cFamily and Friends\u201d, quienes ahora se consideran tambi\u00e9n propietarios o peor a\u00fan, est\u00e1n distanciados o fallecidos;<\/li>\n\n\n\n<li>Haber firmado como fiador o aval a alguien de quien jam\u00e1s se verific\u00f3 si cumpli\u00f3 o no con su obligaci\u00f3n de pago, dejando comprometido el patrimonio personal;<\/li>\n\n\n\n<li>Otorgamiento de poderes, representaciones o mandatos sobre nuestros activos sin haberlos luego cancelado, o requerido rendici\u00f3n de cuentas;<\/li>\n\n\n\n<li>Delegar a un tercero la facultad de calcular, fondear y pagar impuestos, sin contar con los comprobantes oficiales respectivos;<\/li>\n\n\n\n<li>Confiar inversiones financieras a cambio de tasas preferenciales sin verificar adecuadamente la administraci\u00f3n y retorno de los recursos;<\/li>\n\n\n\n<li>Y un largo etc\u00e9tera.<\/li>\n<\/ul>\n\n\n\n<p id=\"ember3314\">Como si lo anterior no fuere suficiente, es com\u00fan encontrar que el interesado carece de la documentaci\u00f3n, antecedentes e informaci\u00f3n que le permitan proceder jur\u00eddicamente a defender su patrimonio, afectando dram\u00e1ticamente sus posibilidades de \u00e9xito.<\/p>\n\n\n\n<p id=\"ember3315\">Otra omisi\u00f3n o descuido se da cuando encontramos patrimonio que lleva a\u00f1os en el abandono, sin producir, depreci\u00e1ndose y expuesto a todo tipo de riesgos.
